1. Overview
CarMaint Ltd (“CarMaint”, “we”, “our”, or “us”) operates a digital platform (“the App”) connecting vehicle owners (“Users”) with automotive workshops (“Workshops”). Through the App, Workshops can send videos, photos, and itemised quotations for vehicle services. Users may accept or decline those quotes, make payments, subscribe to recurring services, and access service history data or paid fleet-management tools.
CarMaint is an intermediary platform only. We do not carry out repairs, employ mechanics, or guarantee work quality. All service agreements are directly between Users and Workshops.
Terms used in this document carry the meaning set out in the CarMaint Master Definitions Document.
2. Definitions
- App
- the CarMaint mobile application and web platform.
- User
- any individual or business using the App to arrange or pay for vehicle services.
- Workshop
- an authorised automotive service provider registered on CarMaint.
- Subscription
- an arrangement for recurring or prepaid services (e.g. Warrant of Fitness plans) offered by a Workshop through the App.
- Fleet Account
- an enterprise account managing multiple vehicles under a paid CarMaint plan.
- Service Fee
- the additional platform fee charged by CarMaint on each transaction.
- Content
- all photos, videos, text, and other materials uploaded or shared within the App.
- Pay In Store
- a payment option where the User settles the job amount directly with the Workshop in person, outside the CarMaint platform.
- Split Payment
- a payment arrangement where the job cost is divided between the User and a third party (e.g. an insurance company), with the User paying their portion through the App or in store.
3. Eligibility
You must be at least 16 years old or otherwise legally permitted to own or operate a vehicle in New Zealand.
If you are under 18, you confirm you have parental or guardian consent to use the App and to enter into service or payment agreements.
4. Registration and accounts
- You must register an account with accurate information and keep your login credentials secure.
- CarMaint may suspend or terminate accounts for misuse, fraud, or violation of these Terms.
- Workshops must provide valid business information and authorisations before listing services or accepting payments.
5. Services provided by CarMaint
CarMaint:
- Hosts an online platform facilitating communication and quoting between Users and Workshops.
- Enables in-app payments and subscriptions processed securely via Stripe, Afterpay, and Zip.
- Maintains optional Fleet Management features for business Users.
- Collects a platform Service Fee on transactions (see section 6).
We are not a party to the underlying contract for vehicle repairs or maintenance.
6. Payments, service fees and subscriptions
a. Payment processing
All in-app payments are processed through Stripe Payments NZ Ltd (“Stripe”) using a Stripe Connect arrangement. Stripe holds your payment for a job until the Workshop marks the job complete, then pays the Workshop directly and pays CarMaint its Service Fee directly, in a single split transaction. Subscription payments are processed the same way. Stripe’s terms and conditions govern all payment activities. CarMaint does not store full credit card or bank details and does not receive, hold, or disburse your payment at any point. Additional payment options including Afterpay and Zip are available through the platform. Each provider’s terms and conditions govern their respective payment activities.
b. Service fees
CarMaint charges a platform Service Fee on top of Workshop pricing:
- 1.25% (plus GST) on in-app payments for quotes.
- 5% (plus GST) on subscriptions.
Example. A Workshop quote of NZD $1,200 → Service Fee = $15 (1.25%). Total = $1,215 + GST.
A Workshop subscription of NZD $100 → Service Fee = $5 (5%). Total = $105 + GST.
The Service Fee appears in-app before payment confirmation. The Service Fee is non-refundable once a transaction has been processed. Stripe, Afterpay, and Zip transaction fees are also non-refundable.
c. How your payment is held
CarMaint does not receive, hold, or deposit your payment into any CarMaint bank account. Stripe holds your payment on CarMaint’s behalf until the Workshop marks the job complete, at which point Stripe pays the Workshop’s share directly to the Workshop and CarMaint’s Service Fee directly to CarMaint. Subscription payments are handled the same way.
d. Subscriptions
Workshops may create predefined or custom subscription options for recurring services (e.g. WOF checks or maintenance plans).
- Subscriptions are structured based on the time period the User selects for payment.
- The User’s acceptance of a Subscription offer forms a direct agreement with the Workshop.
- Subscriptions may be cancelled and are fully refundable minus the 5% Service Fee and any non-refundable transaction processing fees.
- Users may also pause their subscription for up to 3 months (up to 3 times) as an alternative to cancellation.
- Workshop performance obligations rest solely with the Workshop.
e. Fleet Management
Fleet Management is a CarMaint platform feature that allows businesses and individuals to manage multiple vehicles and drivers through a single account. Fleet Management is available on the following monthly subscription tiers:
- Up to 10 vehicles — NZD $99 per month.
- 11 to 30 vehicles — NZD $149 per month.
- Over 30 vehicles — NZD $199 per month.
Fleet Management includes the following features:
- Vehicle assignment — each vehicle is assigned to an individual driver within the account.
- Notifications — both the assigned driver and the fleet manager receive all vehicle-related notifications, including WOF due dates, service reminders, and maintenance alerts.
- Mileage tracking — drivers receive an automatic monthly mileage reminder. The reminder interval can be adjusted to suit individual driver requirements.
- Tiered spend approval — Fleet accounts operate a spend approval hierarchy: Driver (maximum spend $100), Manager (maximum spend $500), Director (unlimited spend). When a spend limit is reached, the job escalates to the next tier for explicit approval before work can proceed.
- Manager dashboard — fleet managers have access to a real-time dashboard showing the status of all vehicles in the fleet, including overdue items, upcoming requirements, and vehicles currently up to date.
- Driver management — fleet managers can reassign vehicles to new drivers at any time.
Fleet Management subscriptions are billed separately through Stripe. Refunds follow CarMaint’s internal subscription refund process and are subject to the same 5% Service Fee deduction and non-refundable transaction processing fees.
f. Pay In Store
Workshops may activate a “Pay In Store” option within the App. When this option is selected, the transaction occurs directly between the Workshop and the User. CarMaint does not process, hold, monitor, or guarantee any payment made in person. The Workshop bears full responsibility for collecting any amounts owed and managing any refunds or disputes arising from in-store transactions. No CarMaint Service Fee is charged on Pay In Store transactions.
Please note that Pay In Store transactions will only save your job data, including any videos or photos taken during the service, for 30 days from the date of job completion. If you would like your service history permanently saved to your CarMaint account, you must pay the CarMaint service fee of 1.25% of the job value. This can be paid at the time of the job or at any point within the 30 day retention period through the CarMaint App. After 30 days, data that has not been retained will be permanently deleted.
g. Split payments
In some cases, such as insurance jobs, a payment may be split between the User and a third party. Where a split payment applies:
- The User is responsible for paying their portion of the job through the CarMaint App or in store, as agreed.
- The full CarMaint service fee of 1.25% is applied to the total job value and is payable by the User. The service fee is not covered by third parties, insurers, or other debtors.
- The third party’s portion of the invoice is managed directly between the Workshop and the third party. CarMaint is not responsible for collecting or pursuing any amounts owed by third parties.
h. Refunds and disputes
Refunds for jobs and subscriptions are decided by the Workshop that provided the service, not by CarMaint. CarMaint facilitates communication of a refund request and may assist in mediation, but does not approve, issue, or guarantee refunds and holds no liability for a Workshop’s refund decision. Please refer to the CarMaint Refund and Cancellation Policy for full details, including how agreed and disputed refunds are handled.
7. Service history and data
CarMaint stores vehicle service history, images, and related records within the App for convenience. We take reasonable steps to protect data but cannot guarantee absolute security. Users should download or export records before deleting accounts. Stored information may be retained for up to seven years after closure for audit and legal compliance.
The stored records are for convenience only and do not replace official invoices or warranty documentation. Workshops remain responsible for maintaining their own service and warranty records in accordance with applicable warranty and consumer law obligations.
Please note that Pay In Store job data is only retained for 30 days unless the CarMaint service fee is paid to permanently save the record. See section 6(f) for full details.
8. Privacy and personal information
CarMaint collects and processes personal information under the Privacy Act 2020 (New Zealand). By using the App, you consent to:
- storage of account, contact, and vehicle information on secure servers (which may be located outside NZ);
- sharing necessary data with Workshops, Stripe, Afterpay, and Zip for transaction purposes; and
- reasonable use of anonymised data for analytics and service improvement.
A comprehensive CarMaint Privacy Policy supplements this section and is available through the CarMaint platform.
9. Marketing communications
CarMaint may send you marketing communications relating to the App and its services. You must actively opt in to receive such communications. You may opt out at any time by using the unsubscribe link in any email or by contacting support@carmaint.com. CarMaint complies with the Unsolicited Electronic Messages Act 2007 (New Zealand).
10. Road testing
By booking a service through the App, the User consents to the Workshop conducting any road testing reasonably necessary to diagnose or verify the repair or service. Road testing is conducted at the Workshop’s sole risk and liability. CarMaint accepts no liability for any loss, damage, or injury arising from road testing carried out by a Workshop.
11. Preferred workshop
Users may designate a preferred Workshop within the App. A preferred Workshop is automatically suggested for future bookings based on the User’s booking history but may be changed by the User at any time. Designation of a preferred Workshop does not create any obligation on CarMaint or the Workshop to provide services.
12. Vehicle service history transfer
Users have unlimited access to their vehicle service history stored on the App. When a vehicle is sold, the current registered owner may initiate a service history transfer through the App to transfer the vehicle’s records to the new owner’s CarMaint account. The transfer must be initiated by the current registered owner. CarMaint is not responsible for transfers not initiated prior to the sale of a vehicle.
13. Intellectual property
All intellectual property rights in the App, branding, and platform code belong to CarMaint Ltd. Users and Workshops retain ownership of uploaded material but grant CarMaint a non-exclusive, royalty-free licence to use, store, and transmit that content for operating or improving the App.
14. Dispute resolution
- Users and Workshops must first attempt to resolve any dispute directly.
- If unresolved, either party may contact CarMaint Support (support@carmaint.com) for optional mediation.
- If still unresolved, disputes may proceed through the Disputes Tribunal or relevant New Zealand court under section 21.
CarMaint has no obligation to determine or enforce outcomes between Users and Workshops.
15. Consumer law and warranties
Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Workshops must comply with all laws governing workmanship, representations, and warranties.
16. Limitation of liability
To the fullest extent permitted by law:
- CarMaint is not liable for any loss, damage, or cost arising from App use, Workshop conduct, payment issues, or data loss.
- We do not warrant uninterrupted or error-free operation of the App.
- CarMaint’s total liability for any claim in a twelve-month period is capped at NZD $100 or the total Service Fees you paid to CarMaint in that period, whichever is less.
These limits do not affect your statutory consumer rights.
17. Termination and suspension
CarMaint may suspend or terminate User or Workshop access at any time for:
- breach of these Terms,
- misuse, fraud, or illegal activity, or
- request by law enforcement.
Users may close accounts anytime via the App. Section 7 governs data retention and deletion.
18. Amendments
CarMaint may update these Terms occasionally. Revised Terms take effect once published in the App. Continued use after posting means acceptance of the changes. Material changes (e.g. fees or functionality) will be notified within the App or by email before taking effect.
19. International use
CarMaint intends to expand to Australia, the USA, and other regions. When using the App internationally, Users are responsible for complying with local laws. Applicable consumer protection and privacy legislation may differ by jurisdiction. Localised versions of CarMaint’s policies will be introduced for each jurisdiction as the platform expands.
20. Miscellaneous
- Force Majeure — CarMaint is not liable for delays or service interruptions beyond its reasonable control.
- Severability — If any provision is found invalid, the remainder of these Terms remains in effect.
- Assignment — CarMaint may assign its rights or obligations to affiliates or successors.
- Notices — Official communications sent to your registered email are deemed received within 48 hours.
21. Governing law
These Terms are governed by and interpreted in accordance with the laws of New Zealand. Any proceedings must be brought before the courts of New Zealand.
